This Pre‑Order Policy explains how pre‑orders for upcoming trading card game (TCG) products work at Gemmintly. It should be read together with our Terms & Conditions, Privacy Policy, and Refund & Returns Policy. If there is a conflict, the Terms & Conditions control unless non‑waivable consumer law requires otherwise.


1) What is a Pre‑Order?

A pre‑order lets you purchase products before their official release date. Release dates are provided by the manufacturer/distributor and can change without notice. Product images, contents, and configuration are subject to change by the manufacturer.


2) Payment & Authorization

  • Payment timing. Unless stated otherwise at checkout, payment is captured at the time you place the pre‑order to secure allocation. If we cannot fulfill all or part of your pre‑order due to allocation shortfalls, we will refund the unfulfilled portion to your original payment method.
  • Expiring authorizations. If your payment method uses an authorization that expires before release, we may re‑authorize or contact you for an updated method to avoid cancellation.
  • Price lock. Your pre‑order price is locked at checkout. We do not adjust for subsequent price decreases or increases. Taxes and shipping may be adjusted if your address changes (see §6).

3) Allocation, Shortfalls & Fulfillment Order

  • Allocation not guaranteed. Distributors may reduce our allocation or delay delivery. In the event of a shortfall, pre‑orders are typically fulfilled on a first‑paid, first‑allocated basis.
  • Partial fulfillment. We may partially fulfill an order and refund any unfulfilled quantity. Promotional items (e.g., buy‑ins, swag) are limited and not guaranteed if allocation is reduced.
  • Substitutions. We do not substitute different SKUs without your consent.

4) Release Dates & Delays

  • Release dates and contents are determined by the manufacturer and may change.
  • If a release is delayed, your pre‑order remains active unless you request cancellation (see §8). We will notify you by email when dates shift materially.

5) Mixed Carts & Combined Shipping

  • Default rule. If your cart contains both in‑stock and pre‑order items (or multiple pre‑orders with different dates), the entire order ships together when all items are ready.
  • To receive in‑stock items sooner or to split shipments by release date, place separate orders.
  • We may, at our discretion, split shipments; additional shipping charges may apply.

6) Address Changes & Verification

  • You may request an address change before your order enters fulfillment. Changes across jurisdictions may affect taxes, shipping costs, and delivery timelines.
  • For fraud prevention, significant address changes may require verification. If verification fails or isn’t completed in time, we may cancel and refund the order.

7) Product Condition & Packaging

  • Sealed product. Minor cosmetic imperfections to outer packaging (e.g., shrink‑wrap scuffs, soft corners) may occur during manufacturing or transit and are not considered defects.
  • Randomization. Contents of sealed boxes/packs are random as determined by the manufacturer; specific pulls are not guaranteed.
  • Singles/graded. If offered as pre‑orders, condition grades are estimates; final grading outcomes are not guaranteed.

8) Cancellations & Modifications

  • Customer‑initiated cancellations before shipment may be requested via email. Approval is not guaranteed and may be subject to a processing fee of up to 10% to cover non‑recoverable costs (e.g., payment fees, allocation commitments).
  • After allocation lock. Once our distributor allocation is locked or your order enters fulfillment, cancellations and quantity reductions are not permitted.
  • Gemmintly‑initiated cancellations. We may cancel for suspected fraud, payment failure, allocation shortfall, or policy violations; you will receive a refund for any canceled items.
  • Order edits. We cannot merge orders, swap SKUs, or add items to existing pre‑orders. Submit a new order for additional items.

9) Returns, DOA & Exchanges

  • Opened product is not returnable. Once sealed product is opened, it is final sale (randomization risk).
  • For damaged/defective on arrival (DOA) or incorrect items, contact us within 72 hours of delivery with photos/video. Resolution may include replacement, exchange, or refund per our Refund & Returns Policy.
  • Manufacturer defects inside sealed product are typically handled by the manufacturer; we can provide contact details when applicable.

10) Quantity Limits & Resale

  • We may impose per‑SKU or per‑customer limits to ensure fair access and to comply with distributor policies.
  • Orders that appear to be for resale or scalping (multiple accounts, freight forwarders, automated purchasing) may be canceled.

11) International Pre‑Orders

  • Duties/taxes/import fees are the buyer’s responsibility and are non‑refundable.
  • International deliveries may be delayed by customs. Release‑day delivery is not guaranteed.
  • Some products may be region‑restricted by the manufacturer; if we must cancel for this reason, you will be refunded.

12) Communication & Updates

  • We will send order confirmations, material release‑date changes, and shipping notifications to the email associated with your account/order.
  • For the latest status, check your order history on the Site or contact contact@gemmintly.shop.

13) Chargebacks & Disputes

Please contact us first to resolve issues. Filing a chargeback without first attempting resolution may lead to account suspension. We provide payment and delivery evidence to processors during disputes.


14) Force Majeure

We are not liable for delays or failure to perform due to events beyond our reasonable control, including supply chain disruptions, carrier delays, natural disasters, strikes, government actions, or manufacturer changes.


15) Changes to This Policy

We may update this Policy from time to time. If we make material changes, we will post the updated Policy with a new effective date. Your continued pre‑order after changes become effective constitutes acceptance.
